The terms and conditions indicated below govern the access and use of the website www.Evelop.com, which is owned by Evelop Airlines, S.L.

Identification of the parties:

Party of the first part, Evelop Airlines S.L. (hereinafter, Evelop), with registered offices at Calle José Rover Motta 27, 07006 Palma de Mallorca, Spain, and tax ID code (CIF) B57797755, registered in the Company Registry of Palma de Mallorca in Volume 2536, Folio 35, Sheet PM71815, Entry 1. Party of the second part, the individual (hereinafter, the User) who enters the website to find out information and purchase services offered on it.

The User declares to be of legal age (i.e. over 18 years of age) and to have the legal capacity to acquire the services offered through the website in accordance with these general terms and conditions, which they fully understand. If services are contracted by a minor, Evelop shall not in any case be liable, with the minor, parents or guardians being obliged to assume any expenses that this may entail.

The use of the website is an agreement between the User and Evelop, by which they expressly accept full and unreserved adherence to each and every one of the Terms and Conditions published by Evelop at the time when the User accesses this website, especially those established on the limitation of liability of Evelop and of any travel or tourism service provider. Therefore, the User must carefully read the General Terms and Conditions each time they intend to use the website, as they may have undergone modifications since the last time they entered.

A) Access and use of User passwords

When registering on our website, the User shall be given a username (their email) and a password chosen by them, which shall then be confirmed by email.

The User is responsible for safeguarding and ensuring the confidentiality of their password, duly preventing access with them by unauthorised third parties. The User agrees to be responsible for the financial consequences arising from any use of the website which may occurs through the use their password provided by Evelop and for the use of their password by third parties.

The User also declares that all the information they have provided in order to access and use the website is truthful, complete and accurate, and undertakes to keep it updated during successive uses which may be made of the services offered on the website.

However, such information is not exempt from exceptionally containing inaccuracies, typos or any kind of material or arithmetic error generated in an involuntary way.

This exemption from liability shall be especially applicable if the sale price is disproportionately misaligned from the reasonable market value of the product and, therefore, clearly incorrect in the eyes of an average user.

C) Purchase of products and services

Purchase of tickets

By purchasing Evelop tickets, the User fully accepts the terms and conditions of the Evelop contract of carriage and unreservedly accepts all the provisions set forth therein. Booking terms and conditions.

Book seats

Seat selections can be made for the reserved flight via the website, after payment. After completing the online purchase process, seat selection will be confirmed and may not be refunded or modified at a later date. A copy of the seat selection must be presented at the check-in desk, which will serve as proof of payment, along with the credit card of the person who paid for the seats. Selections are subject to the restrictions stated for each seat.

The age of infants (0 to 2 years old) must be taken into account, as there can never be more infants per booking than the number of adults. This service will be limited to certain flights and must be confirmed within the established time frame (2 months to 3 days before departure date).

Additional services

The website enables passengers to buy additional flight services tailored to their tastes and preferences. With this option, Evelop provides its customers with the opportunity to choose a premium in-flight menu, priority check-in, and several other additional

For the same reason, the sale of duty free tobacco or alcohol is not allowed on domestic flights or on flights from Spain (except the Canary Islands) to any country within the European Union. Payment methods for on board sales:

    1. Cash: Euros (notes and coins). For payments in other currencies (only notes are accepted), please check with the cabin crew, who will let you know about the currencies accepted on the flight and the exchange rate applied.

TERMS AND CONDITIONS FOR THE PURCHASE OF PRODUCTS FROM OUR ON BOARD MAGAZINE PRIOR TO DEPARTURE

Evelop offers passengers the chance to buy items from our on board magazine via this website prior to departure. Our magazine is available on the website to be viewed by Users. The terms and conditions of product availability according to the type of flight and the accepted payment method are the same as those indicated for the previous section (sale of on board boutique products). PAYMENT OF THE ORDER SHALL BE MADE ON BOARD THE FLIGHT. The order may be made up to 72 hours before departure.

RIGHT TO CANCEL:

The User may cancel a contract in certain cases without needing to justify their decision or pay a penalty.

Regarding the carriage of persons, according to Article 93 k) of Royal Legislative Decree 1/2007 approving the Reviewed Text of the General Law for the Defence of Consumers and Users ('Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios'), the regulation of virtual sales (with the exception of of Article 98.2) does not apply to passenger carriage agreements. As a result, the right of withdrawal does not apply to the booking of passenger carriage services. Therefore, if the USER expresses their desire to cancel the purchased tickets, the cancellation terms and conditions of the airline shall apply.

D) Payment Methods

The User agrees to pay for the purchased services or products before the flight (except for duty free products, which are always payable on board) by using one of the following payment methods, as listed on the payment page:

Debit cards (Visa Electron and Maestro) or credit cards (Visa and MasterCard) for website payments.

Therefore, the purchase of any product shall only be effective when Evelop charges the total amount of the service/product purchased to the credit card provided by the User, or the amount of said purchase is received in cash or with proof of transfer, which may be cancelled by Evelop until such time, without the user being entitled to any claim whatsoever.

Requesting a service/product entails a commitment by the customer to authorise the charge on the credit card provided. If it is not possible to charge the credit card (charge rejected), the User accepts that Evelop shall not issue the booking made or deliver the product purchased.

The prices shown on the website include airport taxes, unless otherwise indicated. They do not include visas or departure fees for specific countries, where applicable, which shall be paid directly at the destination. Variations in the rate applicable for late payment of airport taxes related to the booking, from the time of booking until the time the ticket is issued, shall be charged to the customer.

INFORMATION ON THE PAYMENT OF FLIGHT TICKETS WITH DEBIT CARDS.

This information is valid only for payments of air tickets made with debit cards. When using a debit card to purchase a flight, the User may have a double pre-authorisation on their debit card for an amount similar to the cost of the ticket. The User need not worry about this, as this double pre-authorisation is temporary and shall disappear after a few weeks.

This is part of the normal operations when a debit card is used for purchasing a flight in Spain.

This issue exists for all airlines and all Spanish travel agencies, and is completely beyond the control of Evelop, so we may not be held responsible for these debit card pre-authorisations.

Debit cards accept charges for amounts lower than the amount available in your account. They also immediately withdraw the money from the account to pay for the purchased item. All Spanish travel agencies are connected to the same system called BSP, which manages payments and collections between individuals, agencies and airlines. Therefore, when attempting to receive payment through this system, debit card issuers such as Visa and MasterCard initially review the amount available in the User's account and issue a pre-authorisation for a negligibly higher amount, i.e a few cents, than the amount payable for the ticket. This means there is a guarantee that when the final charge arrives that amount has not been used for another purchase. The charge is then made directly to the card for the exact amount of the ticket purchased.

In standard operations with debit cards, the second charge immediately cancels out the initial pre-authorisation. However, when this system (BSP) is used, the payment is made and the pre-authorisation remains in the User's account until the next settlement date of their card. Normally this pre-authorisation is cancelled at the beginning of each month, between the 1st and the 5th, although this settlement may be weekly for some cards, such as Visa Electron. This issue is known by payment systems and is due to a limitation in the design of communications between the computer systems of the payment method, the computer systems of banks and the computer systems of collections and payments used by travel agencies in Spain, which occurs only with debit cards.

To avoid this inconvenience, we recommend that you use credit cards, pay at one of our agencies or make a transfer (more information on 902 222 008) for flight bookings. Please contact us if you require further clarification.

E) Delivery of documentation.

After payment of the product/service, Evelop will deliver the corresponding documentation to the User, sending it directly to their email address when it concerns electronic documents or vouchers.

After completing the booking, the User shall review its content in order to identify possible material errors while entering data. To correct such errors, the User shall call our booking centre included in the list or send an email to reservas@Evelop.com, providing the identification details of the booking.

F) Privacy Policy

Evelop respects Users' right to privacy and therefore shall apply all current regulations in order to protect the identity of each of its Users. Please find below all the details on the registration and processing of User information in accordance with the provisions of current regulations on the protection of personal data.

To book the products and services which Evelop offers via its website, the User shall provide the personal details indicated in the Customer Sign-up. This allows us to personalise our services and tailor them to their interests and needs.

The User agrees to update this information periodically, letting us know about any changes which may occur to their data and which they have registered on our website. Cookies are required for the use of our website. Cookies are used to store status information while browsing different pages of our website or when returning to the website at a later date. The user has the option to configure the browser to be notified on-screen about receiving cookies and to prevent them from being installed on their hard drive. Please check the instructions and manuals of your browser for further information.

In compliance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, the User is hereby informed that, upon completion of the customer sign-up, their personal data shall be stored in automated files owned by Evelop.

Some of the aforementioned recipients may be located outside the European Union and have access to all or part of the personal data collected by the carrier (surnames, name, passport number, travel details, etc.) for the correct execution of the passenger carriage contract or due to a specific legal authorisation. Transfers of data made outside the European Union shall be made in accordance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data ('Protección de Datos de Carácter Personal').

In accordance with the laws and regulations applicable in Spain and internationally, the carrier may be obliged in certain cases to disclose personal data to authorised Spanish or foreign public authorities (customs, immigration, etc.), especially for preventive purposes or for the fight against terrorism or other serious crimes.

Some of the aforementioned recipients may be located outside the European Union and have access to all or part of the personal data collected by the carrier (surnames, name, passport number, travel details, etc.) for the correct execution of the passenger carriage contract or due to a specific legal authorisation. Transfers of data made outside the European Union shall be made in accordance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data ('Protección de Datos de Carácter Personal').

This data is collected in order to provide the User with our services, process them (management and payment of purchased products and services), create the contract of carriage and send information and advertising about Evelop deals, promotions and recommendations, for which Evelop shall disclose their personal data (name and surname) to the companies, providers or organisers of said products and services, which is absolutely essential for processing the booking; and data of an optional nature which reflects their preferences for the specific and appropriate provision of the purchased service. It goes without saying that the passenger may exercise their right to object to the collection and processing of this data, but they are hereby informed that this could lead to the cancellation of the trip or the inability to access certain extra services as requested (special dietary requirements, etc.).

Likewise, it should be remembered that, in accordance with the laws and regulations applicable in Spain and internationally, failing to provide certain data or providing inaccurate data could lead to a decision to deny boarding or entry to a foreign country, without the carrier being considered liable for such a circumstance. The passenger (i) explicitly authorises evelop to transfer or, where appropriate, share said data with companies of the Barceló Viajes Group engaged in retail travel, wholesale travel, hotel services, air travel and passenger carriage, so that they can be used for the aforementioned purposes; and (ii) agrees that, pursuant to Article 22 of Law 34/2002 on Information Society Services and Electronic Commerce ('LSSI'), evelop and the companies in its group may send them commercial messages by email or similar means. The User may exercise their rights of access, rectification, cancellation or opposition granted by the Spanish Data Protection Act ('LOPD') by sending a certified letter to the attention of the Data ('LOPD') Protection Coordinator (evelop Airlines S.L.) C/ Rover Motta 27, 07006 Palma de Mallorca (Spain) in the terms established by the Data Protection Agency. Travel Newsletters and Advertising:

Messages and their attachments are intended for the specified recipient, so if the User receives them by mistake, they shall notify the sender, remove said messages from their system and shall not be allowed to use them, totally or partially, for any purpose whatsoever. The content may include confidential or legally protected information and solely expresses the opinion of the sender. Internet-based email does not guarantee the confidentiality or the correct receipt of messages. If the recipient does not consent to the use of email, they must immediately inform us. When the customer signs up to and explicitly agrees to receive our travel newsletter, the User also agrees to the possibility of receiving adverts included in said newsletters.

We shall use the information made available to us by the User to send them deals, promotions and recommendations about products and services which we think may be of interest to them.

Evelop and the User undertake to operate in full compliance with the Unconsented Advertising Policy regulated in the Law on Information Society Services and Electronic Commerce. In particular, they undertake to:

  • The User's data shall be processed confidentially and hosted on secure servers that meet the requirements established by Spanish legislation on the protection of personal data.
  • Refrain from disclosing said data to any company outside Evelop.
  • Refrain from sending electronic messages not requested by the User.
  • Include the word "Advertising" in the travel newsletter which the User signed up to on our website.
  • Allow the User to unsubscribe or modify their data in said messages.
  • The User allows Evelop to use said data for the provision and administration of services and communications between Evelop and the User in different ways: email, social media, telephone or mobile messages in their different variants.
  • Within the website, there are links to other websites offered to the User solely for information purposes over which Evelop has no control and for which logically it is not responsible. Evelop does not guarantee the information on any of these third-party websites, which have been included on the understanding that Evelop deems that they are helpful to the User.

The traveller is responsible for complying with government requirements for departure, entry and other kinds of paperwork. Said information can be found on the website of the Spanish Ministry of Foreign Affairs (www.maec.es).Evelop may incorporate additional specific terms and conditions which shall be published on the website.

Security:

Online enquiries and requests for services or products via our website are conducted via a secure server. The software of said server encodes the information you enter before transferring it to us. We also have strict security procedures regarding the storage and disclosure of data in order to prevent unauthorised access thereto, pursuant to Article 9 of Organic Law 15/1999, of 13 December, on the Protection of Personal Data, which is currently in force in Spain. Therefore, we will ask you to identify yourself by using your password before providing you with information regarding your personal data.

G) Copyright, trademarks, software

All content of the Evelop.com website, including content, trademarks, graphics, logos, icons, buttons, images and software, is the property of Evelop or its content providers and is protected by national and international regulations on industrial and intellectual property. The circular icons representing social platforms are owned by MediaLoot - www.medialoot.com.

The selection, compilation, layout, programming, design and set-up of all the website content is the exclusive property of Evelop and is protected by national and international regulations on industrial and intellectual property. All the software used on the website owned by Evelop or its software providers is protected by national and international laws on industrial and intellectual property.

Any other use of the content or photographs on the website is strictly prohibited, including the reproduction, modification, distribution, transmission, subsequent publication, exhibition or representation, in whole or in part, without the express consent of Evelop or its providers.

H) General information, legislation and jurisdiction

Evelop reserves the right to modify, restrict or cancel these General Terms and Conditions at any time.

If any clause included in these General Terms and Conditions were to be declared fully or partially null or void, this shall only affect said clause or the part thereof which is deemed null or void, with all other terms and conditions remaining in force, with said clause or part thereof being duly deemed to not be in force.

Evelop reserves the right to deny or withdraw access to the website, at any time and without prior notice, to any Users who fail to comply with these General Terms and Conditions or who misuse the services and contents published therein.

These General Terms and Conditions shall be governed by Spanish legislation. The parties submit, at their own will, to resolve conflicts before the courts in the city of the User's registered address, thereby renouncing any other jurisdiction.
